MEMORANDUM OPINION
RALPH G. THOMPSON, District Judge.
This suit for cancellation of an oil and gas' lease commenced in state court on Decern ber 28, 1978, and was properly removed by defendant to federal court. A motion for certification of class was denied by the Court and plaintiffs subsequently amended to add additional parties plaintiff. Defendant has moved for summary judgment and plaintiffs have responded. The Court ordered defendant to reply to the issues raised in plaintiffs’ response and this additional brief has been received.
