This matter is before the Court on Plaintiffs Motion for Preliminary Injunction and Defendants’ Motion to Dismiss. For the reasons that follow, Plaintiffs Motion is granted and Defendants’ Motion is denied.

BACKGROUND

1. Facts

Defendants include Xcel Energy, Inc., a multi-billion dollar, publicly traded utility holding company headquartered in Minneapolis, Minnesota.
