Presently before the court is AcroMed Corporation’s (“AcroMed”) Motion for Partial Reconsideration of Pretrial Orders 409 and 438 issued by this court in MDL 1014 (Docket #3859). 1 AcroMed has requested the court to reconsider its ruling in both Orders and to deny the motions to remand cases in which Plaintiffs have alleged a conspiracy claim predicated on alleged violations of the Federal Food, Drug & Cosmetic Act (“FDCA”) and the Medical Device Amendments (“MDAs”) thereto.
