OPINION

YOCK, Judge.

This contract case comes before the Court on the defendant’s motion for sum*772mary judgment. While the defendant has raised various arguments in its motion, its primary argument is that this Court lacks subject matter jurisdiction over the plaintiffs claim for a postal refund and consequential damages for the untimely delivery of political mail by the United States Postal Service. For the reasons set forth below, the defendant’s motion for summary judgment is granted, and the plaintiff’s complaint is to be dismissed without prejudice.
