MEMORANDUM AND ORDER

JOHN W. POTTER, District Judge:

This matter is before the Court on the motion for summary judgment of all defendants, plaintiffs’ opposition and defendants’ reply. Counts III and VI of the complaint were previously dismissed voluntarily by plaintiffs. Also before the Court is plaintiffs’ request for a jury trial.

Under the Federal Rules of Civil Procedure, summary judgment is proper only where there is no genuine issue of material fact and the moving party is entitled to judgment as a matter of law. Fed.R.Civ.P. 56(c). The Supreme Court has recently stated that the inquiry…
