The plaintiff, while engaged in breaking rock as a part of the process of crushing it for use in the surfacing of a state highway, sustained an injury to his hand. Claiming that at the time of the injury he was an employee of the Security Construction Company, he presented a claim for compensation for the injury to the State Industrial Accident Commission, but the claim was rejected upon the ground that at the time of, the injury (1) he was not an employee of said company, and (2) because he had not filed with the commission, as required by Section 6636, Or.
