The complaint in this case seeks damages from the purchaser of the subway cars for the Metropolitan Area subway system for its alleged intentional delay and failure to provide an adequate administrative remedy to adjudicate some 42 claims (originally consolidated in a single claim of 55 subparts) for equitable adjustment involving $48,283,-643 in alleged increased costs caused by changes in design, specifications, time or rate of delivery and increase in the amount of services to be furnished.…
