— William D. Comer and F. F. Powell were charged, by information which contained twenty counts, with the crime of grand larceny. The first ten counts charge larceny by embezzlement; the second ten charge larceny by aid of false and fraudulent representations. To the information, the defendants demurred, and also moved that the state be required to elect upon which group of charges the case would be tried.
