This is a controversy between the town of Berthoud, a municipal corporation, plaintiff in the action, and several ditch and reservoir companies. The state and division water officials of water district No. 4, are only nominal parties defendant. In 1883 in an appropriate statutory proceeding in this water district, priorities were awarded to the defendants’ ditches or canals and in 1890, in a supplementary proceeding, for their reservoirs.
