Defendant was convicted of the July 20, 1966, first degree murder of A1 Weinstein, proprietor of Walnut Park Furniture Store in Portland. Weinstein was seen alive in ¿nd around his store, at and after 9 a.m. At 10 a.m. he was found dead in his burning store. He had been bludgeoned on the head- and died from these wounds, although death may have been hastened by heat and carbon monoxide from the fire.

Two of the witnesses linking, defendant with the crime were convicts, Marvin Baines and Daniel Beed. Baines testified that defendant and one Talley, both of whom he knew, had flagged him down as…
