— This is an action by plaintiff Palmcroft Development Company against the City of Phoenix to recover certain moneys advanced by plaintiff and its assignors under contracts or agreements with the city, by the terms of which such moneys were advanced to be used in installing extensions of its water and sewerage systems to subdivisions of the city largely owned or controlled by the plaintiff and it assignors.
