This case comes before the Court on remand for reconsideration after our Supreme Court vacated our previous opinion. See Ward v Michigan State Univ, unpublished opinion per curiam of the Court of Appeals, issued January 27, 2009 (Docket No. 281087), vacated and remanded 485 Mich 917 (2009).
