MEMORANDUM OPINION AND ORDER

Plaintiffs United States of America, ex rel. Lawrence Walner, and Lawrence Walner, individually (collectively “Walner”) filed suit against Defendants NorthShore University Health System (“NorthShore”), Dr. Timothy Votapka (“Votapka”), and John Does 1-10 (“John Does”) (collectively “Defendants”) alleging violations of the False Claims Act (“FCA”) (Counts I, II, and III) and common law fraud (Count IV) , and seeking injunctive relief (Count V) .
