MEMORANDUM OPINION AND ORDER

INTRODUCTION

In this action, Plaintiff Thomas Eisen-rich has sued his former pension plan, the Minneapolis Retail Meat Cutters & Food Handlers Pension Plan (the “Plan”), alleging that the Plan improperly suspended his pension payments. Eisenrich appealed the suspension to the Plan’s Board of Trustees (the “Board”), but his appeal was denied; he then commenced the instant action. Presently pending before the Court is the Plan’s Motion for Summary Judgment on Counts 2 and 3 of Eisenrich’s Complaint. 1 For the reasons set forth below,…
