MEMORANDUM OPINION
ALBRITTON, District Judge.
I. INTRODUCTION
This cause is before the court on a Motion for Summary Judgment filed by the Defendant, Togo D. West, Jr., in his official capacity as Secretary of the Department of the United States Army (“West”).
The Plaintiff, Brenda Perryman (“Perry-man”) initiated this case with claims for breach of a settlement agreement and for employment discrimination and retaliation under 42 U.S.C. §§ 2000e et seq. (“Title VII”) and 42 U.S.C. § 1981. West’s subse quent motion for dismissal was granted by this court as to the § 1981 claim. West now moves for…
