MEMORANDUM OPINION
ALBRITTON, Chief Judge.
I. INTRODUCTION
This matter comes before the court on Defendants, Alabama Department of Public Safety’s and L.N. Hagan’s, Motion for Summary Judgment filed on June 18,1998.
Plaintiff, Henrietta Merriweather, filed her Complaint in this case on June 26, 1997 in the United States District Court for the Middle District of Alabama. On February 12, 1998, Plaintiff filed an Amended Complaint.
