Calvin Guthrie, Thomas Joyce and Martin Joyce were jointly charged, in an indictment returned by a grand jury impaneled in Pierce county, with the crime of grand larceny. A fourth defendant, Charles Owens, was named in the indictment, hut was dismissed in the progress of the trial and testified as a witness for the state. The defendants seasonably interposed a motion to set aside the indictment and a plea in abatement, which were denied, as were a challenge to the sufficiency of the evidence and motions to dismiss and for a directed verdict at the close of the case.
