Allen, J.:

This case involves a claim for compensation under the workmen’s compensation act. Orville C. Stapleton, an employee of the state highway commission, suffered an injury on January 16, 1937, which resulted in his death. This is an appeal from a judgment of the district court of Finney county sustaining an award in favor of the claimants, Pansy Stapleton, widow and guardian of Willard R. Stapleton, minor dependent.
