Plaintiff, Richard D. Thomson, commenced this action pursuant to the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621 et seq., and the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001 et seq. Plaintiff, a former Chairman and Chief Executive Officer (“CEO”) of defendant Rumrill-Hoyt, Inc. (“Rumrill”), alleges that defendants terminated his employment on account of his age, and that they wrongly denied him certain pension benefits.
