Plaintiff employed one Shively as its manager. Defendant became surety for his fidelity up to the sum of $4,000. It is claimed that the manager’s shortage under circumstances amounting to larceny exceeded this amount. The jury found for plaintiff. Defendant now appeals from an order denying its alternative motion for judgment or a new trial.(1) The defendant attacks tbe sufficiency of the evidence.
