Plaintiff brought this action against the administratrix of the estate of Robert J. Jermstad, deceased, to recover damages claimed to have been ■sustained as the result of an automobile collision. It appears that on October 7, 1953, plaintiff was operating his automobile in a southerly direction on ■“One Mile road,” a so-called through highway in Cal- lioun county.
