delivered the opinion of the court.

On May 24, 1905, appellant issued a policy insuring appellee for one year in the sum of $2,000 against loss by fire of certain ice in an ice house on the north shore of Silver Lake,. Kenosha county, Wisconsin. On July 13, 1905, the building and its contents were destroyed by fire. Appellee made proofs of loss. Payment was refused on the ground that the policy had been can-celled before the fire. Appellee brought this suit upon the policy.
