This is an appeal from a judgment of the Appellate Court for the First District affirming a judgment of the circuit court of Cook county for costs in favor of appellee, in a suit brought by appellant against appellee, in an action of assumpsit on an insurance policy. The cause is here upon a certificate of importance. Trial was had before a jury in the court below, and at the close of the evidence the court directed the jury to find the issues for the defendant, which was done and judgment for costs entered upon the verdict.
