MEMORANDUM OPINION

MARTIN V.B. BOSTETTER, Jr., Bankruptcy Judge.

The issues here arise on the complaint of Richard A. Bartl, Receiver in Bankruptcy1, *227seeking a determination by the Court that a deed of trust conveying to the defendants an interest in real property formerly held by the bankrupt, Philander P. Claxton, III (“Claxton, III”) is null and void as fraudulent to creditors.

The deed of trust in controversy encumbers 5.3 acres of a land parcel in McLean, Virginia, consisting of approximately 7.3 acres, with a residence (“the property”), and of which the bankrupt was, until May 22, 1979,…
