MAHONEY, Justice.
A civil action was brought by the plaintiff who was injured on September 14, 1940, while he was working aboard the defendant’s vessel, the S. S. Steel Pier, docked at Commercial Wharf, Boston, for the recovery of damages under Section 33 of the Merchant Marine Act of 1920, 41 Stat. 1007, 46 U.S.C.A. § 688, called the Jones Act.
