This action was brought by respondents against the appellant railroad company and one of the company’s engineers to recover damages for the death of respondents’ minor child and serious injuries to respondent E. S. Judd, Jr., arising as the result of a railroad crossing accident. Since E. S. Judd, Jr., was the active party to ■whose conduct reference will be frequently made, we will refer to him as “respondent.” The jury returned a verdict against the railroad company for $15,720 and against the engineer in the sum of $1; judgment was entered on the verdicts.
