I. INTRODUCTION
Plaintiff M.B., a minor, filed this action through her mother and next friend, plain tiff Nicole Martin (“plaintiffs”), against the Liverpool Central School District (“the District”), pursuant to 42 U.S.C. § 1983. This action stems from the District’s denial of M.B.’s request to distribute a “personal statement” flyer, concerning the impact Jesus Christ has had on her life, to some of her friends and classmates at Nate Perry Elementary School during non-instructional time.
