SULLIVAN, Judge:

On September 1 and 2, 1988, the accused was tried by military judge sitting alone as a general court-martial at Garlstedt, Federal Republic of Germany. Contrary to his pleas, he was found guilty of rape, assault and battery, and false swearing, in violation of Articles 120, 128, and 134, Uniform *176Code of Military Justice, 10 USC §§ 920, 928, and 934, respectively. He was sentenced to a dishonorable discharge, confinement and forfeiture of $600.00 pay per month for 24 months, and reduction to the lowest enlisted grade. The convening authority approved the…
