Plaintiff Joyce Fischman brings this action against defendant Blue Cross & Blue Shield of Connecticut, Inc. (“Blue Cross”) to recover medical expenses incurred in the treatment of her late husband, Sidney Fischman (“Fischman”). Contending that Fischman’s treatment related to a pre-existing condition excluded by the employee welfare benefit plan it issued, Blue Cross now moves for summary judgment.
