HAMILTON, District Judge.

Plaintiff Charlotte Pitcher brought this action for damages against her employer’s health insurer, Principal Mutual Life Insurance Company. Pitcher’s coverage under the Principal Mutual policy became effective on September 17, 1992. One day later, a biopsy showed that Pitcher had breast cancer. She underwent surgery and radiation therapy. Principal Mutual has refused to pay for Pitcher’s biopsy, surgery, and radiation treatments, relying on the preexisting-condition clause in the insurance policy. The parties have filed…
