MEMORANDUM OPINION
KESSLER, District Judge.
This matter is before the Court on Defendants’ Motion to Dismiss or, in the Alternative, for Summary Judgment. Plaintiffs Frede Garcia, Lawrence Caldwell, and Antonio Tirado are District of Columbia Department of Corrections inmates. They bring this action under 28 U.S.C. § 1983 against Department of Corrections employees Rosamaría Chapa, James Harvey,.
