Plaintiff, Michael Don Romacho, a former employee of Bowne of New York, Inc. (“Bowne”), commenced this action against the Trustees of the Bowne Profit-Sharing Plan and Trust (the “Plan”) pursuant to the Employee Retirement Income Security Act of 1974 (“ERISA”) 1 because of their refusal to accelerate distribution of his vested interest in the Plan’s fund (“Fund”) on the termination of his employment.
