A jury found appellant guilty of the burglary (Pen. Code, § 459) of the Old Clock Restaurant in Monterey. He appeals from the judgment of conviction.

The restaurant was burglarized during the night of January 1-2, 1967, between the hours of 11:30 p.m. and 3:30 a.m. Three days previously, at 3 :30 a.m. on December 29, Officer Gregg of the Salinas Police Department saw a 1957 Cadillac being driven in that city.
