The United States Trustee, joined by Capital Cities Communications, Inc. (“Capital”), requests this Court to abstain, pursuant to § 305(a) of the Bankruptcy Code, 11 U.S.C. § 305 (“Code”), from exercising jurisdiction over this Chapter 13 proceeding brought by debtor Anthony Martin-Trigona. Alternatively, they move for a dismissal of the case under § 1307(c) of the Code with prejudice.
