OPINION AND ORDER
LEISURE, District Judge:
Plaintiffs allege defendants violated (1) the Racketeer Influenced and Corrupt Organizations Act (“RICO”), see 18 U.S.C. §§ 1961-68, and (2) section 2 of the Sherman Act. See 15 U.S.C. § 2. In addition, plaintiffs seek a declaratory judgment, see 28 U.S.C. § 2201, that two United States patents origi nally obtained by defendant Hologie are invalid and unenforceable. Defendants, pursuant to Fed.R.Civ.P. 9(b) and Fed.R.Civ.P. 12(b)(6), move to dismiss the RICO and antitrust claims. In addition, defendants move to dismiss the request for a declaratory…
