JOHNSON, J.

Jose Juan Pulido seeks review of an order in his habeas corpus proceedings, denying his motion to examine a material witness in Mexico on a commission, pursuant to Penal Code section 1349 et seq. We issued an order to show cause. Having considered the parties’ petition, return, and reply, and having heard oral argument, we deny the petition.
