Plaintiff appeals from the judgment rendered subsequent to our decision on a prior appeal (Skog v. Pomush, 219 Minn. 322, 17 N. W. [2d] 641) affirming the order denying his motion for a new trial on the ground of newly discovered evidence. The opinion fully states the facts, except those relating to a motion to amend certain statements of fact in the order denying the motion for a new trial, which are challenged here for the first time on this appeal.
