On August 17, 2007, Qwest Communications Corporation (“Qwest”) filed a Complaint for Declaratory Relief against the Maryland-National Capital Park & Planning Commission (“M-NCPPC” or “the Commission”). The Complaint alleges that Qwest is a company that provides telecommunication services in Maryland, and that in “order to provide these services, it locates its telecommunications facilities on Commission property.” Compl. ¶ 1.
