DECISION AND ORDER
WARREN, Chief Judge.
The parties’ cross-motions for summary judgment are before the Court.
I. PROCEDURAL BACKGROUND
Baker filed this action on March 8, 1990, alleging inter alia that Amoco violated the Petroleum Marketing Practices Act (“PMPA”), 15 U.S.C. § 2801 et seq., by terminating and not renewing his franchise. Amoco filed its answer and counterclaim on April 3, 1990. By a stipulation and Order of July 13, 1990, the Court dismissed the counterclaim with prejudice and without costs. On October 11, 1990, the Court ruled that Baker is entitled to a jury trial in this action.…
