David B. WEIHAUPT, Plaintiff-Appellant, v. AMERICAN MEDICAL ASSOCIATION, Defendant-Appellee

Court of Appeals for the Seventh Circuit

Decided July 7, 1989No. 88-1745, 88-2043PublishedCited by 155 opinions

1Opinion of the Court

COFFEY, Circuit Judge.

Plaintiff David Weihaupt appeals the district court’s grant of summary judgment and award of costs in favor of the American Medical Association (“AMA”), Wei-haupt’s former employer, in an age discrimination suit under 29 U.S.C. § 621, et seq. (“ADEA”). We affirm the grant of summary judgment in favor of the AMA. Because the district court failed to decide whether the AMA’s requested costs are allowable and reasonable both in amount and necessity, we vacate the portion of the district court’s judgment awarding costs and remand for such a determination.
