Theresa D. Crooks sued MIReal Estate Partners, Ltd., Moses Management, Inc., Robert A. Moses, Jr. (collectively, the Ml defendants), James Moses, and others to recover damages for personal injuries suffered at a social gathering. A previous summary judgment in appellees’ favor was affirmed in part and reversed in part. See Crooks v. Moses, 138 S.W.3d 629, 642 (Tex.App.-Dallas 2004, no pet.) (Crooks I). We remanded Crooks’s claim for negligent undertaking and the derivative liability issues of agency and vicarious liability related to that claim.…
