■Appeal by the people from a judgment of the general term of the supreme court, in the first department, reversing the conviction of defendant, Thomas Moran, in the court of general sessions, of an attempt to commit larceny in the. second degree. The indictment in this case charged the defendant with an attempt to commit the crime of grand larceny in the second degree, by attempting to steal, take, and carry away from the person of an unknown woman, in the daytime, in the city and county of New York, certain goods, chattels, and personal property of a kind and description unknown, and of the alleged value of $10. It is claimed that the evidence did not show an attempt to commit a larceny.
