The accusation against the appellant, by *281information in the Common Pleas, was that he did, on the 14th day of April, 1871, at the county of Montgomery, and State of Indiana, in a rude, insolent, and angry manner, unlawfully touch, strike, beat, and wound George H. Justice, with the intent, then and there, feloniously, forcibly, by vio-r lence, and putting him, the said George H. Justice, in fear, to take from the person of said George H. Justice a certain five dollar bill, current money of the United States, of the value of five dollars, the personal property of said George H. Justice, etc.
