The main issue in this case concerns the timeliness of an appeal to a zoning board of adjustment. On January 7, 1980, the Ames city building official issued a building permit to Arkae Development, Inc. (Arkae), for the construction of a duplex at 4006-4008 Ontario Street in Ames. At a city council meeting on February 19,1980, council member Charles Hammer, who represented the ward in which that property is located, was approached by a constituent from his ward who told him that a hole was being dug on the lot adjacent to 4006-4008 Ontario.
