MEMORANDUM AND ORDER
FREEDMAN, Chief Judge.
The City of Springfield, Massachusetts— one of two defendants — moved for summary judgment. This Court referred the motion to a United States magistrate pursuant to 28 U.S.C. § 636(b)(1)(B). On December 13, 1988, the Magistrate issued a report recommending that this Court grant the City’s motion on all counts. Now before the Court are plaintiff B & R Realty’s written objections to the Report and Recommendation and the City’s opposition thereto. Defendant Springfield Redevelopment Authority has not taken a position on this matter.
