COPERTINO, J.
On this appeal, we revisit the question of whether agreements to arbitrate the custody of minor children should be enforced by New York State courts. We hold that they should not be enforced.
The salient facts of this case may be summarized briefly. The plaintiff Miriam (Ungar) Glauber and the defendant Baruch Glauber were divorced by judgment of the Supreme Court, Kings County, dated May 15, 1985.
