I. INTRODUCTION

This ease arises out of an application for a building permit for a pier project on the northern end of Clark’s Island which is a heronry site located in Plymouth Harbor, Massachusetts. On November 20, 1995, Plaintiffs, John and Susan Baker (“the Bakers”), brought this action under 42 U.S.C. § 1983, alleging that Defendants, employees of the Massachusetts Executive Office of Environmental Affairs (“EOEA”), violated their due process and equal protection rights by wrongfully denying them a building permit (Count I) and their First…
