In accordance with the instruction then given by this court, *110the court below sustained the demurrer to the complaint, and thereupon the appellees filed an amended complaint, which alleged, in substance, that Sarah J. Allen, widow of Joseph M. Allen, deceased, who was the son of Thomas W. Allen, was,, by the court of common pleas of Washington county, Indiana, on the 15th of December, 1865, duly appointed guardian of the persons and property of Frank, Charles and Heber…
