MARTIN, Justice.

The state appeals of right the decision of the Court of Appeals and presents to this Court the question of whether the trial court erred in denying defendant’s motions to dismiss the state’s case for insufficiency of the evidence. N.C.G.S. § 15A-1227 (1983). We find no error in the trial court’s rulings and reverse the Court of Appeals.

The evidence, viewed in the light most favorable to the state, showed that on 18 September 1986, the victim, who had turned sixteen less than one week before, was living with her mother and younger brother in an Asheville mobile home park.…
