Rumsey, J.:
The appellant is' a domestic corporation organized for the purpose of making mica pulp, flour paste, gums and like articles which are extensively used in the manufacture of wall paper and other business of that kind. It is alleged in.the complaint that on the 14th day of September, 1895, one Delery was the sole owner of a manufacturing business of that kind which was carried on in the city of New York.
